Welcome to StableState! These Terms of Service govern your use of the StableState DCIM monitoring platform (the "Service") provided by StableState LLC ("StableState," "we," "us," or "our").

Critical Systems Warning: The Service is not designed or intended for use in life-critical, safety-critical, or mission-critical systems where failure could lead to death, personal injury, or severe physical or environmental damage. 13.1 Governing Law

These Terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict of law provisions.

13.2 Jurisdiction

Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Racine County, Wisconsin. You consent to the personal jurisdiction of these courts.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, SLA, and any other referenced policies, constitute the entire agreement between you and StableState regarding the Service.

14.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

14.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

We are not liable for any failure or delay in performance due to events beyond our reasonable control, including natural disasters, war, terrorism, pandemics, labor disputes, or internet outages.
